DEFINITIONS

Seller means Cheetham House Consultants Limited T/A British Attire (Cheetham House, Far Cromwell Road, Bredbury, SK6 2SE) registered as a Limited Company in the United Kingdom, Company Registration Number 11921605 (Registered Office – Cheetham House, Far Cromwell Road, Bredbury, SK6 2SE) and the company's web site www.british-attire.com

Customer

means the person or company to whom this document is addressed.

  1. GENERAL

These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as British Attire, to the buyer hereafter referred as the Customer.

  1. PRICE

2.1

All prices are quoted in the selected currency (from GBP, EUR, USD or CAD) and are inclusive of VAT (as may be prescribed by law from time to time) where applicable, depending on the chosen delivery destination.

2.2

Prices are inclusive of postage and packing worldwide for all orders over £40. Orders below this value can be delivered for a small additional fee and delivery upgrades can be selected at checkout where applicable.

  1. PAYMENT

Payments are made in the selected currency (from GBP, EUR, USD or CAD) by one of the following payment methods:

Major credit and debit cards and online payments such as Apple Pay and Google Pay are accepted and processed through Shopify payment. 

 

Payment is taken at when the order is placed. All orders are subject to security checks to protect our customers. You may be contacted by our customer care team to confirm payment details.

3.1. SALES CONTRACT

As per the Consumer Contract Regulations (2013) British Attire is under a legal duty to supply goods that are in conformity to the contract. British Attire reserves the right to cancel any order up to the point of delivery.

  1. PASSING OF PROPERTY

British Attire shall retain the property of the goods until full payment has been made by the customer and has been received.

  1. PASSING OF RISK

The risk in the goods shall pass to the Customer on delivery, as defined in clause 6.3 below.

  1. DELIVERY

6.1 DELIVERY DATES:

Any date provided for delivery should be considered as indicative, it is our policy to dispatch all orders placed by 4 p.m. U.K. on the same day, but this cannot be absolutely guaranteed. Any products not available at the time of your order will be sent to you as soon as possible, we will inform you via email in the unlikely event of any delay. British Attire cannot be held responsible for delays to deliveries caused by couriers or any other third party.

When placing your order you should receive an automatic order confirmation email. Unless explicitly requested all our communication with you will normally be made through email, it is therefore imperative that you correctly state your email address when ordering.

6.2 SHIPPING

We deliver anywhere worldwide, including BFPO. Orders will be shipped via Courier or Royal Mail, orders over £200 GBP in value will require a signature on delivery, except where specifically requested otherwise by a customer (at their own risk). Packages over £100 GBP in value arrive within 1 working day in the UK (unless a different delivery day is requested at checkout or there is a external delay outside of British Attire's control). Orders delivered to addresses outside the U.K. normally arrive within 2-14 days, but can occasionally take longer if delayed by customs. All parcels are insured in transit. Delivery performance during busy times, such as Christmas, may be slightly lower, but British Attire endeavour at all times to meet or exceed our customers’ expectations.

6.3 PASSING OF RISK

Where the goods are signed for, the customer bears the risk once the goods are signed for. If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods.

In the event of a damaged or lost parcel, British Attire will forward a claim to the appropriate courier on the behalf of the customer. British Attire will liaise with the customer to replace or trace the missing item(s).

Failure to give accurate information while making a claim may lead to a prosecution from the courier company.

  1. ACCEPTANCE

The Customer will inspect the goods within a reasonable time after receipt and shall be deemed to have accepted the goods if we have not been informed by email or letter of the desire to cancel within 14 days of receipt, or if cancellation notification is not received (see Cancellations section below for more information), the goods have not been returned to us within 21 days of receipt. If no such action is taken, British Attire will assume that the goods have been accepted as suitable and as described. At British Attire’s own discretion, returns for exchange/store credit will be considered after the expiry of these deadlines

  1. RETURNS PROCEDURE

8.1

If the goods are to be rejected in the time limit set in clause 7 above, the Customer shall comply with the return procedure as defined in clause 8.2, below. British Attire will not accept any returned goods should the return not follow the aforementioned return procedure.

8.2

All returns made without prior order cancellation must be received within 21 days of receipt to the following address -

Any used, soiled, worn (other than briefly to try for size) or excessively handled goods will not be eligible for return or will be subject to a deduction from the reimbursement. Underwear, hosiery and swimwear that has been worn in any way is non-returnable.

A receipt of posting should be obtained.

Please allow 28 days for your returned item to be delivered back to us. Returns made within the UK are free of charge if our Royal Mail pre-paid label or our Collect + account is used. Returns from outside the UK are at the sender’s cost, we cannot be held responsible for parcels that are lost in transit to us. Returns made under order cancellation as per the Consumer Contracts Regulations as at the sender’s cost in all cases (see full details below).

Returns will be refunded within 14 days of their receipt by British Attire.

8.3

In cases where the rejection of the goods is due to a defect in an item, the Customer is entitled to a replacement. The faulty or damaged product may be returned to the manufacturer or British Attire before the replacement can be issued. Postage costs (from outside the U.K.) will be refunded to the customer on inspection of the goods and confirmation of fault by the manufacturer or ourselves.

8.4

In cases where the rejection is due to an incorrect order from the Customer or to dissatisfaction, the Customer is entitled to a refund only, exchange or credit note for full value.

8.5

In cases where the customer does not sign for the goods on delivery or for whatever reason, they are not accepted by the customer and returned, we will offer either to re-send the package, or to refund the original payment.

  1. CANCELLATIONS MADE UNDER THE CONSUMER CONTRACTS REGULATIONS (2013)

9.1

Customers wishing to exercise their right to cancel under the Consumer Contracts Regulations (CCR’s) must do so within 14 days of the receipt of their order. The cancellation period will expire after 14 days from the day the order is delivered. The Customer can inform us of their wish to cancel their order under the CCR’s by using one of the following methods –

9.2

Returns made under the CCR’s are at the customer’s own cost and should be posted to the address under 8.2.

Goods should be sent back to us without delay and in any event not later than 14 days from the day on which you communicate your wish to cancel. Returns inside the UK are free of charge only where the right to cancel under the CCR’s is not exercised. In all other cases the Customer must return the goods at their own cost.

9.3

If you cancel this contract under the CCR’s we will reimburse all payments received, except for premium delivery charges where they were selected at checkout.

We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling, e.g.’s if clothing or footwear has been worn other than to try for size, items are soiled or where underwear/swimwear has been worn under any circumstances.

We will make the reimbursement without undue delay, and not later than 14 days after we receive back from you any goods supplied, or 14 days after you supply evidence of returning the goods, or if there were no goods supplied; 14 days after the day on which we were informed.

We will make the reimbursement using the same means of payment used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

All of our products are guaranteed for a minimum of 1 year under normal usage.

  1. PRIVACY POLICY

Any information passed through to countryattire.com is via a secure connection on the internet using Secure Socket Layer technology at 128bit encryption (where browsers will allow). If a customer wishes for their information to be removed from our database, this should be requested in writing at our registered office (please see below) or to info@british-attire.com

Please note credit card details are not retained. The only information stored is a customer's transaction history, name, address & e-mail address. These may be used for marketing purposes by British Attire.. Customers will not be sent 'spam' e-mail. Should any customer not want their details used for marketing purposes, please tick the relevant box at the checkout or request to be removed at info@british-attire.com

We will never share, sell, or rent your personal information with third parties for their promotional use unless we have your permission.

  1. LICENCE AGREEMENT

The Customer shall respect all license agreements delivered by the copyright owners. British-attire.com cannot be held responsible or liable for any misuses conducted by the Customer or any third party. All trademarks, graphics and pictures shown on countryattire.com belong to their registered owners and must not be copied or reproduced without prior permission.

  1. LAW

These terms and conditions are governed and shall be interpreted in accordance with English Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.
